This agreement is made for our mutual benefit to protect the purchaser and the breeder, as well as to clear the conditions of purchase.
Our kittens are guaranteed to be of good health at the time of sale. This kitten is guaranteed to be healthy and free of disease and other health conditions originally present at the time of leaving Pocket Leopards Cattery (unless otherwise indicated and agreed on by Buyer and Seller). The general health guarantee period is 72 hours from take home date. Stress related health conditions are not part of this health guarantee and will not be covered. It is recommended that you have the kitten examined by a certified veterinarian within 72 hours (or 3 business days) of receiving the kitten. Kitten must remain quarantined from other pets until first vet check. Please note that failure to do this will render all guarantees null and void. Optionally, and at the expense of Buyer, Buyer may request that Seller have vet check done prior to leaving Pocket Leopards Cattery. If an illness occurs during the 72 hour guarantee period, the breeder must be notified immediately. If the kitten is found to be medically deficient from a problem originally present on take home date, the kitten is to be returned to Seller for treatment and will be returned to Buyer as soon as possible after deemed healthy by Seller or Sellers vet. In the event of an un-treatable or life-threatening condition, Seller will replace kitten/cat with one of equal value as soon as one becomes available. Replacement kitten/cat is to be chosen by Seller, not Buyer. The costs of shipping a replacement and/or return of the kitten to Seller/Buyer is the sole responsibility of Buyer. Under NO circumstances will there be given a cash refund for kittens or cats purchased. If Terra Sinclair is no longer breeding cats then a replacement kitten will not be provided.
Further, we guarantee all kittens for a period of twelve months against genetic or congenital defects that cause death. If during this time your kitten dies and your veterinarian finds it to be genetic or congenital defect, a Necropsy test result from your veterinarian stating cause of death will be required for a replacement kitten. Under NO circumstances will there be given a cash refund for kittens purchased. If Terra Sinclair is no longer breeding cats then a replacement kitten will not be provided.
This kitten has been sold as a household pet at the above price, but can be shown in Alter/Household Pet, however there are NO guarantees on show wins.
Pocket Leopards Sales Agreement
By initialing the below terms, buyer agrees to abide by them. If buyer breeches ANY of the below terms of this contract all guarantees of this contract will be null and void. The Seller has the right to take back the above said cat/kitten with all paperwork and, offspring, if any. Buyer may also be liable for monetary damages to Seller. Buyer Shall Pay all Court Cost and Legal Fees Incurred by the Enforcing of this Contract.
_____ That under NO circumstances will there be CASH or any monetary reimbursement for vet bills or replacement Kitten.
_____That this kitten is not to be given a FIV or FIP vaccination or any other unproven vaccine except what is required by law. If FIV / FIP vaccine is given, all health guarantees will be void. Please see the info on page 3 of this contract regarding our vaccine policy.
That this kitten or cat is never to be resold or surrendered to a shelter or similar facility.
To provide immediate medical care if the kitten shows signs of illness or distress.
To spay or neuter kitten by six (6) months of age and provide seller with proof in the form of a certificate with microchip number included. No registration paperwork will be given until proof of spay/neuter is provided to seller by buyer. Unless breeder already has procedure done in advance.
Not to breed the above said kitten or cat.
That certain conditions such as coccidiosis and upper respiratory illness can arise due to stress from change and/or other cats/kittens in buyer’s home and are not part of the health guarantee.
_____ Breeder is not liable for any contagious illness (FELV, FIV, etc) once the kitten leaves cattery, if not present on take home date of kitten. The only exception is FIP. FIP is covered for 6 months after take home date. (please see attached information on FIP)
_____ That although we make every effort to prevent parasites, Breeder is not liable for any parasite infection, even if present prior to placement or at the time of placement of the kitten.
_____ That the breeder CAN NOT guarantee there will be no changes of color, contrast, pattern, features or size of the above said kitten. Cosmetic or any non-life threatening defects are not covered.
_____ Any down payments submitted on above said kitten are NON refundable, unless kitten dies prior to leaving Terra Sinclair’s home, or Terra Sinclair decides to cancel sale to Buyer. Terra Sinclair reserves the right to cancel sale at any time prior to taking kitten home, for any reason. Shipping in non-refundable after shipment/delivery has been made or attempted.
_____ To allow Terra Sinclair to personally or to have their own veterinarian examine your kitten/cat, look at necropsy results, examine records, or contact your veterinarian for information to be able to guarantee replacement of above said kitten/cat.
_____That the terms of this contract and any business dealings between Terra Sinclair and Buyer shall remain confidential. Never is any negative information such as disputes or health status of kitten to be posted publicly on the internet or elsewhere.
_____ I understand and agree that the breeder is never responsible for any zoonotic diseases potentially contracted through this animal and that there is a risk of zoonotic disease when a human comes in contact with any animal.
_____ I agree to complete sale of said kitten/cat by date specified by breeder. If buyer backs out of sale either by non-response/lack of communication by buyer (non- response after 15 days after date that final sale was to be made), or by notifying breeder they have backed out, Breeder has the right to relist kitten for sale and any/all down payments/monies paid to breeder, will be forfeited to breeder. It is buyer’s responsibility to keep breeder updated with telephone numbers and addresses.
_____ I agree that IF FOR ANY REASON, the buyer cannot retain ownership of the cat/kitten, that the breeder will be notified so that the breeder may assist in placing the cat/kitten into another home.
In as much as the below signed understands and accepts these terms and conditions, they are aware of the penalties to be incurred by violation of this contractual agreement. They are aware that this contract is a legally binding contract by law in the state of California, in the County of Sacramento. They are aware that interstate litigation is within the expenses to be absorbed in full by the BUYER in question at the time of purchase. This is considered to be effectual and enforceable; all disputes will take place in the County of Sacramento in California Courts under California Law. If any terms of this contract should become unenforceable, the remainder of the contract shall remain enforceable. I HAVE READ AND FULLY UNDERSTAND THE STIPULATIONS OF THIS CONTRACT.
We recommend that this kitten not be vaccinated for Rabies before 6 months of age. (Except where required earlier by law) To avoid over vaccination, ask your vet about a titer test for rabies after the first vaccine. This gives the immune system a chance to mature. The use of the Feline Leukemia vaccine is not recommended. Vaccination for FeLV/FIV and FIP will void the health agreement. All current methods of testing for the FIV virus will show a "positive" for cats vaccinated with the FIV vaccine. What this means to you or me is frightening in its ramifications. If we vaccinate our cats against FIV and one of them is lost, or simply gets picked up by an animal control officer, it will likely be destroyed as an FIV-positive cat. There is simply no way of knowing which "positive" cat is truly infected and which cat has simply been vaccinated against FIV.
We do not routinely vaccinate our kittens for any vaccines other than what is required by law or to ship cat internationally. Never vaccinate a cat for anything if the cat is sick, or during another procedure or surgery like
spay or neuter surgery.
It is advisable not to vaccinate a cat on the first vet visit. Let it settle into your
home first and get comfortable. The use of the anesthetic “Ketamine” is not recommended for bengals. Please discuss this with your vet.
To the best of our knowledge this kitten/cat is free of parasites (fleas, ticks, intestinal parasites, ear mites, etc) at the time of sale. We use REVOLUTION topical for deworming and as a flea and mite preventative. We recommend you continue to treat your kitten with REVOLUTION once a month. We also use PANCUR / FENBENDAZOLE or something similar for parasite control. Your kitten may receive one round of treatment before going home with you, depending on weather we feel this treatment is needed. We try to remain as treatment free as possible, but sometimes it is necessary to treat. If your kitten remains on a raw meat diet, we recommend you treat your kitten with this every three months to prevent parasite infection.
Stress from a new environment can cause a healthy kitten to become ill. It is not unusual for a kitten to get an upper respiratory illness (like a common cold) or other stress related illness immediately after going to a new home. With good care, the symptoms should subside rather quickly. Please contact us and your vet if you have any questions or need advice.
This kitten cannot be guaranteed to be free from Feline Enteric Corona Virus (FeCV). It is estimated by a research physician at the University of Missouri Veterinary Teaching Hospital that 93.7% of all cats have contracted Feline Enteric corona Virus. FeCV can, on rare occasions, mutate and cause the fatal disease FIP. The effectiveness of the FIP vaccine is still controversial. Many researchers and veterinarians. Believe it can create enough stress on the feline immune system to actually cause the disease, others believe that it is completely ineffective. Although research is continuing, at this time no one knows exactly why this disease occurs, or how to completely prevent it. Therefore, this entire health guarantee is null and void if the FIP vaccine is administered to this kitten. Once again, the breeder cannot guarantee that this kitten will never contract this disease. Your kitten has been fed a raw food diet (any dark meat of the chicken, along with some heart) – with supplements and the bones from said animals included. (cats/kittens must have TAURINE). Please try and keep your kitten on a raw meat diet as it is the most healthy option. However, if you are going to make your own, please research on the correct way to make it or your kitten could suffer terrible effects from malnourishment. NEVER feed cooked meat as the main part of the diet. Cooked meat has little nutritional value for a cat. Cooked bone can splinter and cause throat or intestinal blockage. Please BE SURE TO SWITCH YOUR KITTEN OVER SLOWLY if you intend to switch your cat onto a commercial canned food or dry food diet. Up until this time, your kitten will only have eaten a species appropriate diet. Sudden switching of food WILL cause severe intestinal upset and a die off of beneficial gut bacteria which will lead to diarrhea and possibly even litter box issues and other health issues like a takeover of naturally occurring bad gut bacteria that can be harmful in large numbers and contagious to humans. No matter how your vet might feel about the raw meat diet, it is the most healthy and natural diet for a obligate carnivore (please see more about this here: http://feline-nutrition.org/answers/answers-what-exactly-is-an-qobligate-carnivoreq) . If you switch over to something else, I also recommend you give your cat probiotics during the transition to help reestablish beneficial gut bacteria. Gut bacteria are responsible for 70% of the immune system and are therefore very important!
I have read the provided information on diet, vaccines, parasites and illness. I promise that I will do further research before I decide to deviate from the protocol that the breeder advises, even if my vet suggests otherwise. I promise that if I switch my cat onto another diet, other than what it ate at breeders, I will do so slowly over the course of at least several weeks or more. I have been warned, and I understand that the breeder is not responsible for any intestinal issues, or health issues that might have been caused from my switching the cat onto another diet, or from deviating from breeder’s protocols on vaccines and deworming as stated above.
